Welcome to Blythly (“we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website, www.blythly.com (the “Site”), and the purchase of our products (the “Products”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use our Site or services.
1. Overview
We design and create made-to-order knitwear, produced responsibly and shipped directly to you. Because each piece is custom-made, please review our order and return policies carefully before purchasing.
2. Eligibility
To use our Site or make a purchase, you must be at least 18 years old or have parental or guardian consent. By placing an order, you confirm that all information you provide is accurate and complete.
3. Products and Availability
All of our items are made to order using organic or sustainably sourced materials. We make every effort to display accurate colors, descriptions, and availability; however, variations may occur due to screen settings or yarn dye lots. We reserve the right to modify or discontinue any Product at any time without notice.
4. Orders and Payment
Orders are placed through our Shopify storefront and processed securely through [Shopify Payments / PayPal / other processor]. By submitting your order, you agree to provide current, complete, and accurate purchase and account information. All prices are listed in [USD or your currency] and are subject to change without notice.
Made-to-order production: Each piece is created after your order is placed. Please allow approximately 2 weeks for production before shipping.
5. Shipping and Delivery
Shipping costs and estimated delivery times are displayed at checkout. We are not responsible for delays caused by carriers, customs, or events outside our control.
6. Returns and Exchanges
After receiving your order, please know you get 14 days to decide if it is right for you. Scan the QR code on the tag to start the return process if something isn’t quite what you expected. Please know returns will only be refunded if you return the garment unworn, undamaged, and unwashed with the tag still attached within 14 days of your order date. We reserve the right to refuse returns that do not meet this criteria. After your garment has passed inspection, please allow up to 10 business days for a refund or store credit to your account. 7. Intellectual Property
All content on this Site—including text, images, logos, graphics, and product designs—is owned by Blythly or its licensors. You may not copy, modify, distribute, or use our content for commercial purposes without written permission.
8. Privacy
Your submission of personal information through the Site is governed by our Privacy Policy. Please review it to understand how we collect, use, and protect your data.
9. Disclaimer of Warranties
Our Products and services are provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Site will be uninterrupted or error-free.
10. Limitation of Liability
To the fullest extent permitted by law, Blythly shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or Products.
Our total liability for any claim shall not exceed the amount you paid for the Product at issue.
11. Indemnification
You agree to indemnify and hold harmless Blythly and its affiliates, employees, and partners from any claims or demands arising from your violation of these Terms or misuse of the Site.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of New Hampshire without regard to conflict of law principles.
Any disputes shall be resolved exclusively in the courts of Strafford County, New Hampshire.
13. Changes to Terms
We may update these Terms occasionally to reflect business or legal changes. The updated version will be posted on this page with a revised “Last Updated” date. Continued use of the Site after changes means you accept the revised Terms.
